Privacy Policy

The North American Numbering Plan Administrator, the Pooling Administrator, and the p-ANI Routing Number Administrator (collectively, “NANPA” or the “Administrator”) is committed to protecting User privacy. This Privacy Policy is desined to inform Users of the Service about how the Administrator, acting as a contractor to the FCC, gathers and uses information provided to, or collected by or on behalf of, the Service and under what circumstances the Administrator will transfer, share or disclose such information. The Administrator takes reasonable steps to protect User privacy consistent with the guidelines set forth in this Privacy Policy and with applicable laws and regulations. By using the Service, you agree to the data collection and use described in this Privacy Policy. Therefore, please read this Privacy Policy carefully.

 

Key Definitions

In this Privacy Policy, the following key definitions are used (other terms are defined in the body herein):

“Content” means information, documentation or media presentation that are displayed on the Site or Service.

“FCC” means the Federal Communications Commission.

“North American Numbering Plan” or “NANP” means the service providing the basic numbering scheme for telecommunications networks located in the United States, its territories, Canada, and parts of the Caribbean.

“Pooling Administration” or “PA” means the service for the administration of thousands-block number pooling in populous areas of the United States. 

“Pseudo-Automatic Number Identification Administration” or “p-ANI” means the service for the management and assignment of non-dialable pseudo-automatic numbers which are used to support the routing of wireless and VoIP 911 calls, out of the 211 NXX and 511 NXX in the United States, Puerto Rico and the Virgin Islands.  

“PII” means information that can be used to distinguish or trace an individual's identity, either alone or when combined with other information that is linked or linkable to a specific individual.

“Service” means, collectively, the NANP, PA and p-ANI.

“Administrator” means the entity awarded the contract(s) through a competitive bidding process by the FCC, pursuant to which the Administrator administers the Service and the Site on behalf of the FCC.

“Service Providers” means reporting carriers as defined in the FCC’s numbering rules, see 47 CFR §§ 52.5(i), 52.15(f)(2), which include wireless, wireline, and interconnected VoIP providers that obtain numbers from the North American Numbering Plan Administrator (NANPA).

“Site” means, collectively, the following websites: nationalnanpa.com, nationalpooling.com, nationalpani.com and any other website, subdomain, URL, or electronic or mobile device application operated by or on behalf of the Administrator solely to provide the Service, either now or in the future.

“Tracking Technology” means cookies, clear GIFs, pixel tags, geolocational trackers or other technology solutions performing similar functions that are used by or on behalf of the  Administrator in connection with providing the Site and the Service.

“User” or “you” means any person viewing or otherwise accessing the Site or the Service as an individual and/or on behalf of an entity, including without limitation, Service Providers, as such term is defined in the Site and Service.

“User Data” means PII and other information, such as anonymized data and/or aggregated data from which data about an identifiable person cannot be obtained.

 


Third Party Websites and Applications

The Service and/or Site may contain links to other websites or applications. The Administrator is not responsible for the privacy practices or the content of any third-party websites or applications. Users should be aware of this when leaving the Service or Site and review the privacy statements on the third-party sites or applications. A link to a third-party website does not constitute or imply endorsement by the Administrator. Additionally, the Administrator does not guarantee the quality or accuracy of information presented on those websites. This Privacy Policy applies solely to information collected by or on behalf of the Administrator in providing the Site and the Service.

 


What Information Does the Administrator Collect?

The Administrator, acting on behalf of the FCC, and/or third parties acting on behalf of the Administrator, collect PII and other information, both directly, in your interaction with the Site or Service, and indirectly through the use of Tracking Technology.  

User Data that the Administrator collects may include, but is not limited to: PII such as your name, user name, IP/MAC address, title, telephone number, facsimile number, email address, and user identification information,  the name, title, company name, telephone number and email address for the individual you may identify as your “authorizer”, registrant company name, company type, and address, as well as any additional supplemental information that the Administrator may request or that you may choose to provide from time to time (including in connection with questions or comments you may provide to us or in connection with seeking support with respect to the Service). 

User Data may also include, but is not limited to: your zip code, unique device identifier, referrer and exit websites and applications, browser type, browser language, operating system, geographic location, date and time of your queries and search queries, as well as information with respect to the interaction between you and the Site or the Service, including but not limited to date and time of your visit, length of your visit and pages viewed. In some instances, such User Data may be considered PII.

 


Use and Disclosure of Information the Administrator Collects

FCC: Because the User Data collected under this Privacy Policy is collected in the Administrator’s capacity as a contractor to, and on behalf of, the FCC, the FCC has access to such User Data.

State Regulators: In certain circumstances, a State regulatory authority may have access to the User Data from or relating to its State.

User Data: The Administrator’s primary goal in collecting User information on behalf of the FCC is to provide Users with the best and most useful Content and Service, to manage the use of the Service and the Site by its Users, and to communicate with Users. The Administrator uses the information to create, develop, operate, deliver, and improve the Site, the Service, and Content and to educate individuals regarding the Service. Except as set forth in this Privacy Policy, the Administrator uses User Data only for the Administrator’s purposes and will not disclose User Data to any third parties, unless it is required to do so by law, regulation or court order, or with your consent. 

PII: From time to time, the Administrator may use your PII to send you important notices, such as communications related to the Site, the Service, the Administrator, and changes to each of the foregoing terms, conditions and policies. Your PII may be deidentified and aggregated and used to help improve the Site and the Service and to better understand how they are used.

Disclosure to Outside Contractors: Except as otherwise provided in this Privacy Policy or in agreements with Users, the Administrator may share User Data with independent contractors, vendors, suppliers, or other third parties engaged by the Administrator (collectively, "Outside Contractors"), such as providers of hosting and/or support services associated with the Service, for the purpose of providing, supporting and improving the Service and Site.

Storage and Deletion: The Administrator stores and processes User Data in the United States, and your User Data may therefore be accessible to law enforcement and regulatory authorities in the United States.  The Administrator reserves the right to store User Data as long as may be permitted by applicable laws and regulations. The Administrator will disable your user account if you ask it to do so by contacting NANPA at support@nanpa.com, unless the Administrator is required to retain it under any applicable laws or regulations.

Improper Conduct: The Administrator may use and share User Data to investigate and help prevent unlawful activity or activity that threatens its network or otherwise jeopardizes the provision or operation of any of the Site or the Service. The Administrator may disclose User Data to third parties (such as law enforcement) to the extent required by applicable laws or regulations or if it believes that such disclosure is needed to help prevent unlawful activity or any activity that threatens any of the Site, the Administrator or the Service.

Tracking Technology: The Service, the Site, email communications, and other interactive applications or services may use Tracking Technology. Tracking Technology helps the Administrator to better understand which parts of the Site and the Service that Users use and visit and to facilitate and measure the effectiveness of the Site, any Service-related surveys, functions or other Content.

The Administrator and third parties acting on behalf of the Administrator may use cookies and other technologies to remember PII, to authenticate Users, and to facilitate provision of the Service when you use the Service or Site. You should only access the Site using web browsers that enable you to control how and whether cookies will be accepted by your web browser. If you reject cookies, some functions and conveniences of the Service or Site may not work properly.  

The Administrator may send email messages, text messages, or “push” notifications from time to time which may include a “click-through URL” linked to the Site or Service. The Administrator, or third parties on its behalf, may track this click-through data to help determine interest in particular topics and measure the effectiveness of the communications to you. The Administrator may also include “pixel tags” or other similar technologies in the email messages, text messages or notifications that tell the Administrator whether the message has been opened or notification received.  The Administrator may use this information to reduce or eliminate messages sent to you and other Users. If you prefer not to be tracked in this way, you should not click the text or graphic links in the messages or notifications.

The Administrator may also collect information through its log files, which record data such as user IP addresses, browser types, domain names, and other anonymous statistical data involving the use of the Service. This information may be used to analyze trends, to administer the Service, to monitor the use of the Service, and to gather general demographic information. The Administrator may link this information to User Data for these and other purposes such as personalizing a User’s experience on the Service and evaluating the Service in general.

The Service, the Site, Administrator and its Outside Contractors, and third parties, may use cross-device/cross-context tracking. For example, if you use multiple browsers on a single device, or use various devices (such as desktops, smartphones, and tablets) to access the Service or communicate with the Administrator, it may result in your having multiple accounts or profiles across these various contexts and devices. Cross-device/cross-context technology may be used to connect these various accounts or profiles and the corresponding data from the different contexts and devices. For the avoidance of doubt, the Site may use third-party service platforms (including to help analyze how users use the Site).  These third-party service platforms may utilize Tracking Technology and may place cookies on your computer or mobile device.  If you would like to disable "third party" cookies, you may be able to turn them off by going to the third party's website.

How Can You Disable Your Account?

The Administrator will only use your information for the purposes described in this Privacy Policy. Please note that while your account is active, you cannot opt out of receiving information about the Service or other information relating to the Administrator, because such information is important and relevant to your use of the Service.  However, the Administrator will, at your request, disable your User account at any time if you contact the NANPA at support@nanpa.com.


International Users

The Service and/or Site are hosted by servers located in the United States. If you are located outside of the United States, your User Data including your PII may be transferred to the United States and if so, will be subject to the legal requirements of the United States, including requirements to disclose information to courts, law enforcement and national security authorities. By submitting your User Data, including your PII, you consent to transfer of your User Data, including your PII, to the United States and to its storage, processing, and use there in accordance with this Privacy Policy and United States law.


Security

The Administrator has implemented reasonable security measures to protect information from loss, misuse and unauthorized access, disclosure, alteration or destruction. Notwithstanding the above, you should be aware that there is always some risk involved in transmitting information over the Internet. There is also some risk that others could find a way to thwart our security systems. As a result, while we strive to protect your information, we cannot ensure or warrant the security or privacy of any information you transmit to us, and you do so at your own risk. The Administrator cannot guarantee against security breaches, including without limitation any that are associated with such public networks, or third-party products and services.

Consent to Communications

To the extent permitted by applicable law, you hereby consent to the Administrator’s use of your contact information for purposes of communications with you by or on behalf of the Administrator regarding the Service and the Site. If you provide an e-mail or other address on your account, you acknowledge and consent to receive business and informational messages relating to the Service and the Site at such address.


Access and Updating of Information

The instructions to review or amend your information by updating your User account settings may be provided in the applicable Service or related documentation or materials provided by or on behalf of the Administrator. You may change information at any time and as often as necessary. If you are experiencing problems with the Service or have questions about how the Service works, please contact the NANPA at support@nanpa.com.

 


General

Administrator Appointment: The Service is provided pursuant to and is subject to the FCC agreement appointing the Administrator as the provider of the Service (the “Appointment”).  In the event of an inconsistency between this Privacy Policy and the Appointment, or to the extent that the Appointment or any regulatory or other directive binding on the Administrator prohibits the Administrator from complying with anything contained herein, the provisions set forth in the Appointment or such regulatory or other directive, as applicable, shall apply.

Registration Password: Your account(s) with the Service may be password-protected to control access to your account by third parties. Do not divulge your password to anyone. The Administrator never asks for passwords. You may not transfer or share your registration password or other credentials.

Business Transfers: If all or part of the Administrator is sold, merged or otherwise transferred to another entity, your User Data may be transferred as part of that transaction.

Amendments: The Administrator may modify or amend this Privacy Policy from time to time. Therefore, the Administrator asks you to check this Privacy Policy occasionally to ensure that you are aware of the most recent version which will apply from the time you access the Site. If the Administrator makes any material changes in the way in which your User Data is collected, used or transferred, it will notify you of these changes on the Site for the applicable Service. If you object to any of the changes, you can have the Administrator disable your user account by contacting the NANPA at support@nanpa.com

Minors under 13: Children under 13 are not permitted to use the Service or the Site and may not submit any personally identifiable information to the Administrator. The Administrator does not knowingly collect any personally identifiable information from children under 13 years old or knowingly distribute such information. If a child under 13 has provided the Administrator with or submitted to the Service any personally identifiable information, the parent or guardian of that child should contact the Administrator immediately at the NANPA at support@nanpa.com to delete this information. 

Telephone Consumer Protection Act: The Administrator may use your information to make business, informational and collections calls relating to the Service to all telephone numbers, including cellular numbers or mobile devices, you choose to provide on your account or in registering for the Site and/or the Service. You agree such calls may be pre-recorded messages or placed with an automatic telephone dialing system. In addition, you agree that the Administrator may send non-marketing Service- or account-related text messages to cellular phone numbers you provide to the Administrator, and you agree to accept and pay all carrier message and data rates that apply to such text messages. You can revoke your consent at any time by exercising your opt-out option as provided above or in a communication the Administrator sends you. You may also inform the representative calling either from or on behalf of the Administrator that you no longer wish to receive future calls related to the Administrator, the Site or the Service. 

 

Enforcement

If you believe that the Administrator has not complied with this Privacy Policy, or if you have any other complaint with regard to collection, use or disclosure of User Data by the Administrator, you may send a written notice of complaint to the address below:
